Terms and Conditions for Shukuno

Article 1: Definitions

Private Chef: The person providing culinary services to the client on a personal or private basis, hereinafter referred to as “Chef.”

Client: The person or entity hiring the Chef, hereinafter referred to as “Client.”

Services: The culinary services provided by the Chef, including but not limited to meal preparation, cooking classes, catering, menu planning, and event guidance.

Agreement: The contractual arrangement between the Chef and the Client regarding the provision of the Services.

Article 2: Services Provided

The Chef will provide the culinary services as agreed upon in the specific booking for the service.

The services may include (but are not limited to):

  • Private meals for individuals or groups.
    (In general bookings are possible from 4 persons* and up to 15 persons**.)
    (*For a booking of 4 people, the 6 course menu and/or the caviar option and/or wine pairings must be chosen. **A booking of more than 15 people can be discussed.)
  • Catering for special events (e.g., dinners, weddings).
  • Cooking classes or workshops.
  • Customized menu planning based on dietary preferences or restrictions.
  • Meals and/or products for takeaway.

Any additional services outside the agreed scope will be subject to extra charges and must be approved by the Client in advance.

Article 3: Payment Terms

Price: The Chef will provide an estimate or quote for the services in advance, based on factors such as the number of guests, type of meal, location, and duration of the service.

Deposit: A deposit of €50 is required when booking the service and is non-refundable, unless otherwise agreed upon in the cancellation policy.

Remaining Payment: The remaining balance must be paid after the service has been provided, unless otherwise agreed upon. The payment deadline is within 14 days.

Payment Methods: Payments can be made via bank transfer, credit card, or any other mutually agreed method.

Late Payments: If the remaining payment is not made on time, the Chef has the right to charge 15% interest per month on the outstanding amount.

Additional Costs: Additional costs, such as ingredient purchases or travel expenses, may be added to the final invoice and must be approved in advance.

Article 4: Cancellations and Rescheduling

Cancellations by the Client:

  • If the Client cancels more than 7 days before the scheduled service, the Client will receive a full refund of the deposit and any payments already made.
  • If the Client cancels within 7 days of the scheduled date, the deposit is non-refundable, but the Chef may offer to reschedule the service for another time.
  • If the Client cancels on the day of the service or fails to show up, the Client will owe the full amount.

Cancellations by the Chef:

In the event that the Chef is unable to perform the service due to illness, an emergency, or unforeseen circumstances, the Chef will notify the Client as soon as possible and offer a full refund or a rescheduled date at no additional cost.

Rescheduling:

If the Client wishes to reschedule the service, this must be done at least 7 days in advance. Rescheduling requests within 7 days of the scheduled date are subject to availability and may incur additional charges.

Article 5: Responsibilities of the Client

The Client is responsible for providing a suitable environment for the Chef to perform their services. This includes a clean kitchen and the necessary cooking equipment.

The Client must inform the Chef of any food allergies, dietary restrictions, or preferences in a timely manner. Failure to inform the Chef may result in certain requests not being fulfilled.

The Client must ensure that the Chef has access to the location at the agreed-upon time and that there are no obstacles or disruptions during the service.

The Client is responsible for arranging parking and access to the event location (if applicable).

Article 6: Responsibilities of the Chef

The Chef will arrive at the agreed time and perform the Services professionally.

The Chef is responsible for the preparation, cooking, and cleaning up after the service (unless otherwise agreed upon). He will leave the kitchen in the same way that it was before he arrived. Used plates and cuttlery can be placed in the dishwasher. 

The Chef will ensure that the food is prepared, cooked, and stored according to health and safety standards in the food industry.

The Chef will maintain the highest hygiene and professionalism standards during the service.

Article 7: Health, Safety, and Allergies

The Chef will take all necessary precautions to ensure food safety and quality. However, it is the responsibility of the Client to inform the Chef of any food allergies or dietary restrictions prior to the service.

The Chef is not liable for allergic reactions or health issues arising from food consumption if the Client has not informed the Chef of allergies or other health risks beforehand.

The Chef is not liable for the incorrect preparation or heating of takeaway meals and/or products done by the client. 

Article 8: Confidentiality

The Chef will respect the Client’s privacy and confidentiality. Any personal or private information shared by the Client will not be disclosed to third parties without permission. 

This confidentiality obligation remains in effect even after the service or agreement has ended.

Article 9: Liability and Indemnity

The Chef is not responsible for any damage, loss, or injury arising from the actions or negligence of the Client, including incidents during food preparation, serving, or consumption. 

The Client will be responsible for any damage, loss or injury towards the Chef if it arises from actions or negligence of the Client.

The Client agrees to indemnify the Chef from any claims, damages, or costs arising from failure to timely or fully disclose allergies, dietary restrictions, or other relevant information.

Article 10: Force Majeure

The Chef is not liable for any delay or non-compliance with their obligations under this agreement if caused by circumstances beyond the Chef's control, such as natural disasters, illness, accidents, or other unforeseen events (force majeure).

Article 11: Governing Law and Disputes

These Terms and Conditions are governed by and interpreted in accordance with the laws of the country where the Chef is located.

Any disputes arising from this agreement will initially be resolved through amicable negotiations. If no resolution is reached, the matter will be brought before the competent court in the jurisdiction of the Chef.

Article 12: Miscellaneous Provisions

These Terms and Conditions may be modified or amended by the Chef at any time. The Client will be notified of any changes.

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
